The businessman, who is the MD of Legend Logistics and Integrated Concept Limited, made the startling revelation, during the arraignment of his wife, Joy Adaku Ojiekomhan, who is facing a two count-charge of conspiracy and stealing before the court.
The police have alleged in charge number; G38/2017, that the 37 years old mother of two had on June 30, 2017, at about 11.30 am conspired with the driver, Emeka Osuh, now at large, to steal the sum of N1.136, 400 million, belonging to her estranged husband’ firm, Legend Logistics and Integrated Concept Limited.
The offences according to the prosecutor, Mr. E. I. Onine, contravened and punishable under sections 411 and 287 of the Criminal Laws of Lagos State of Nigeria, 2015.
The defendant had pleaded not guilty to the charge.
However, in the course of urging the court to admit her to bail, her lawyer, Mr. J. Uwabuche, informed the court that the matter is between husband and wife, and that both families are taken step to resolve the matter.
In response, the prosecutor, Mr. Onine told the court that though bail is at the discretion of the court, and he is not against the court admitting the defendant to bail.
But said the matter before the court is that of conspiracy and stealing, and that court should grant bail on that account.
Probing further to know if the complainant and the defendant are couple, the presiding magistrate, Helen Omisore, asked from Moses Ojiekomhan, the defendant’s estranged husband what transpired between them.
Then Moses said: “We once lived together as husband and wife but we have now separated. They have charged me to court for child abduction.
“I caught Emeka, who is a driver in my company, sleeping with her in my house”.
The prosecutor backed Moses’ claim. He said police investigation into the matter, revealed that Moses and Joy were once couple but separated when Joy and Emeka (the driver), who is now at large, were caught in immoral act.
Explaining the side of his client to the court on the allegation by Moses that Court 4 Ogba Chief Magistrate Court, issued a warrant of arrest against him because the 18 month-old baby from the collapsing marriage is in his custody, after his estranged wife accused him of abduction, Joy’s lawyer said his client was charged to court today in order to prevent her from being in Ogba court tomorrow.
To be more sure of the stories narrated by all parties, the Presiding Magistrate, Omisore, called for the case file, and after perusing it, admitted the defendant to bail.
The Magistrate then adjourned that matter till September 27, for mention.
