A Federal High Court sitting in Abuja has been asked to sack President Muhammadu Buhari as the Minister of Petroleum Resources.

Former President of Nigerian Bar Association (NBA),
Dr Olisa Agbakoba, SAN, filed the suit challenging Buhari’s holding of the office of Minister of Petroleum Resources without being confirmed by the Senate.

The suit was in pursuant to Section 1 (1) and (2), 138 and 147 (2) of the 1999 Constitution of the Federal Republic of Nigeria. And according to Agbakoba, Section 138 of the Nigerian 1999 Constitution forbids the President of Nigeria from holding any other executive office or paid employment.
He is asking the court for an Order restraining Buhari from continuing to hold the office of Minister of Petroleum, while in office as President of Nigeria.

“I am greatly concerned about the recently management crisis in the Nigerian National Petroleum Corporation (NNPC), particularly disagreements between Dr Ibe Kachikwu, the Minister of State for Petroleum and Mr Maikanti Baru, the Group Managing Director of the NNPC, over the administration of the NNPC,” he added.
